Best Bankruptcy Attorney In Indianapolis Helps Local People With Money Problems

May 12th, 2010

In Indiana, people are in just as much trouble with foreclosures and debt problems as in the rest of the country. When it starts to look like there is no light at the end of the tunnel, it is time to call your Indianapolis attorney. He can help you out of the mess.

There is a point where it just does not make sense for you to try and stay on top of bills that just keep getting bigger. The inflated bills can get out of hand from high interest rates, late fees, over limit fees, and a number of other credit card debt rules that are unfair to the consumer. Then the collection agencies begin harassing you, belittling you, calling you during dinner times, and so on.

In some cases, if you are late, your interest rate will go up. This compounds the problem in a way that makes it sometimes impossible to get ahead at all. The billing department personnel may not even want to talk to you, let alone make arrangements for payment.

At this point, your lawyer can make it all stop. You have tried your best. You have made the payments that you could. You realize you let the bills get too high, but there were things you needed, and now you cannot get out from under them. You deserve a break.

When it is time to go bankrupt, there are things you need to know. Chapter 11 gets rid of all of your debts. And you can keep your residence, unless it is in foreclosure, of course. Chapter 7 may consolidate your bills and even lessen them, but they still need to be paid off.

Bankruptcy is not for everyone, but some people are very relieved after they have gone through one. They have no problem paying for items that they can afford with the money that they have, never to get into debt again. This will be the way to handle this final decision, as it will take years to get credit again. It is difficult to rebuild your credit, when nobody will give you a loan. Many companies frown on bankruptcy, and many car insurance companies will charge more for auto insurance because of your bad credit. An Indianapolis attorney can take care of your debt problems, when this is your last resort.

Helping debtors to get through a bankruptcy filing is just one of the areas of specialization that can be arranged by an Indianapolis attorney. For more information about other areas of legal practice, visit the website at http://coreyscottlaw.com .

Professionalism and Respectfulness in Court Reporting

May 12th, 2010

If you desperately require a court reporter service and you’re on the lookout for the right selection factors, you will encounter two theories of recommendation: One that tells you to judge a court reporters service and another that inspires assessing the independent court reporter abilities.

In this presentation we’ll discuss choosing the best individual court reporter based on their talents. Attorneys who contract with court reporters say there are two groups of selection factors you should be aware of and applied to your hiring outcome. The first is the reporters basic skills and secondly to their overall professionalism and reputation.

Depositions can become quite sleepy. On the other hand they can become quite fast paced when attorney and witness begin to talk over one another. This can make it quite difficult for a court reporter to remain on task and not miss any of the conversation. A court reporter also needs PC stenography skills and research ability. Depending upon the type of litigation support you want it may be more difficult to find what you’re looking for.

An attorney will expect a clean and precise legal transcript from any pre-trial deposition they have hired a court reporter to record. When hiring a court reporter make sure that one of their abilities is proof reading skills that were taught as part of a professional program.

Outstanding Professionalism and Reputation: Some attorneys and organizations make the error of thinking a court reporter’s personality and demeanor doesn’t matter. While court reporters have interaction with witnesses, their degree of poise, professionalism and respectfulness can truly have a bearing on the standard of a pre-trial deposition. Just as judges and attorneys are not proof against bias and adversarial thoughts, neither are court reporters.

Aside from interrupting a witness and sabotaging an attorney’s line of querying or mis-portraying a witness’s nonverbal behavior, court reporters that are lacking professionalism may also be a technical nightmare to the reporting process. From showing up for pre-trial depositions in dysfunctional clothes to arriving late and not delivering logs on time, less than professional reporters have done it all. To judge a reporter’s professionalism or lack thereof, it is a smart concept to research their past work history and not just depend on the court reporting firms appraisal of their demeanor.

A Deadly Mesothelioma Exposure Encounter

May 12th, 2010

Mesothelioma is a kind of cancer that’s nearly always caused by getting exposed to asbestos. In this disease, malignant cells develop in the mesothelium, a protective lining that covers most of the body’s internal organs. Its most common site is the pleura ( outer lining of the lungs and internal chest wall ), but it could also happen in the peritoneum ( the liner of the intestinal cavity ), the heart, the pericardium ( a sac that surrounds the heart ) or tunica vaginalis.

Mesothelioma exposure typically occurs when people inhale or ingest airborne asbestos fibers. Asbestos is a natural compound and was extensively used in manufacturing a wide variety of products like cement, insulation equipment, construction materials etc. It is extracted from natural sources and made into thin strands, which are then woven into threads before being put to industrial use. Its use increased greatly during the Second World War in ship building and related war period activities and continued till governments banned extensive use of asbestos after discovering the relationship between asbestos exposure and occurrence of mesothelioma.

In spite of all the positive aspects, asbestos has a serious drawback. The inhaled particles can cause cancer to mesothelium, which is the protective membrane of our vital internal organs. The disease becomes noticeable only after a long duration of time, may about fifty years later. The delay in diagnosis results in the death of many patients. The disease must have assumed alarming proportions before the infection is detected.

Till now many have been infected through mesothelioma exposure. People residing near the site of extraction, those working in factories where asbestos is used in a large scale and family members of the workers who come into contact with the particles through their cloths and hair are at greater risks of contracting the disease. Now different protective measures like wearing protective masks, having a bath and changing cloths before leaving the work place are undertaken. But many have already lost their lives to this fatal disease and many are living at the mercy of physicians and strong medicines. In addition, most of the present day patients are those people who got infected when there were no curbs and precautionary measures.

Basically three types of cancer are caused by mesothelioma exposure. They are Pleural Mesothelioma, Peritoneal Mesothelioma and Peritoneal Mesothelioma. The most commonly found Mesothelioma cancer is the Pleural variety. Pericardial Mesothelioma is the most rarely found one, but it is the most deadliest of all. It has been found that the diagnosis of Mesothelioma is not that easy. Hence the best possible thing to do is to undergo medical check ups to detect any cancerous growth in the mesothelium. This has to be done by all who have been exposed to asbestos at one point or other in their life.

Why You Should Always Report Any And All Work-Related Injuries

May 11th, 2010

The Workers’ Compensation Board is requiring a plastic manufacturing company to justify its apparent failure to provide information on multiple work-related injuries; otherwise, they will be assessed a $52,500 fine. The company failed to report at least 21 injury cases in a timely manner as shown by a state-run investigation. Legally, a company is required to report an injury within ten days.

The manufacturer was instructed to present itself at a hearing to demonstrate that it had adhered to the law and had reported the injuries to Workers’ Compensation. Even though the investigation discovered there were a lot of cases dated back to the previous year, they had still not been reported. Apparently, up until that point, no employer had ever faced this type of discipline.

The option to penalize companies for not reporting their workers’ injuries was first instated in 1944, but research of the law revealed no prior case records of any companies being subjected to such penalization. A legal representative of the business in question couldn’t even turn up any such cases. The firm’s lawyer is known to specialize in legal matters involving Workers’ Compensation.

None of the members of the board has yet made any comment pertaining to the allegations. The company’s human resource manager announced that they anticipate the hearing will bring closure to the charges. They are hoping for an impartial assessment of all of the facts presented thus far, as well the chance to clarify the underlying situation.

The company has been blamed by several employees and the steelworkers’ union for intentionally omitting information regarding the injuries to the Occupational Safety and Health Administration and the Workers’ Compensation Board. They believe the company was able to save money by not reporting the injuries as the law requires. Companies must by law compensate injured workers for their lost time and provide for their medical expenses should a worker be kept off the job by their injury.

However, as a lawyer with United Steelworkers of America pointed out, by under reporting job related injuries a company avoids triggering a full scale inspection of their business, and doesn’t have to pay compensation to workers when injuries reoccur some 30 years later. After the union’s allegations, the company filed 60 more cases of non-related injuries, some that went back to 1994, with the Worker’s Compensation Board. The company stipulated that some of these cases ought to have been reported sooner, but stated that there had been a misunderstanding of the reporting requirements.

Should the Board discover the firm has transgressed the law, they’re apt to face fines as steep as $2,500 for every case not disclosed within the mandated 10-day period. On top of that, the company will be susceptible to criminal allegations. Workers’ Compensation has delegated further action into the case to the state attorney general’s criminal fraud division.

The investigation is on-going based on further accusations that more employees were injured – some losing small body parts – and the incidents were not reported.

A former employee has alleged in a $350,000 lawsuit that the firm canceled her health insurance while she was on Workers’ Compensation as they at the same time were taking her payments for the premiums.

A call to the international union to open a large-scale investigation into company affairs was made by the Director of the United Steelworkers of America; the director’s demand was seemingly motivated by the union’s discoveries at their single plant under fire. The business in question has four plants in Illinois and Indiana aside from the one in question.

How Can Bankruptcy Help?

May 11th, 2010

Different chapters are suitable for varying needs, but bankruptcy, in essence, offers assistance for debtors through the automatic stay on creditors’ actions following the filing. The automatic stay ensures that all forms of harassment that debtors can experience, including letters, phone calls along with other demands for payments, must stop. Consequently, if all of the requirements from the court are met in the honest and open manner in accordance with complete disclosure, several types of discharge can be utilized allowing the debtor to take up their lives or businesses once more.

People weighted down by consumer debt, particularly credit card debt, can expect having this debt knocked out since most credit card debt is unsecured. Debtors filing under chapter 7 have to make their non-exempt assets available for liquidation to secured creditors. The debtor has to give payment or give up the collateral. Unsecured creditors will not receive complete payment or, indeed, any payment. The bankruptcy court designates a trustee who arranges a meeting with creditors and handles the disposal of assets to creditors in line with their status. At the completion of the process the debtor almost always receives a discharge; consequently the debtor is relieved from the cumbersome debt and able to start life afresh without more harassment from creditors.

Although chapter 7 is an approach predicated on relieving debt, there is also a provision for reaffirmation of a specific debt assuming the debtor can verify sufficient income. In cases like this the debtor makes arrangements with a creditor to keep hold of certain property. Chapter 7 does not mean the loss of all assets, so household assets and exempt property can normally be retained.

Other approaches to bankruptcy look into reorganization as opposed to liquidation. These approaches involve the development in the form of a repayment plan to ensure that the debtor can keep property or a business following the reorganization, and under some cases consolidation, of debt. The reorganization approach is chapter 13, and its suitable for individuals that have a steady income sufficient enough to retain their property and manage their mortgages given assistance and guidance.

Once again the debtor receives relief on filing on account of the hold on creditor actions, and co-debtors will also be protected from creditors. A repayment plan is created during debt counseling, although unsecured creditors may receive little or no repayments based on the debtor’s situation. After three to five years, the debtor will probably get a discharge of debts.

Family farmers and fisherman are offered chapter 12 a comparable approach to managing debt but one which encompasses increased debt burdens such as those connected with operating these businesses.

Businesses have an option to file for chapter 11 with the chance to stay in control and operate the business, eventually, eliminating the debt burden. This option is the best option for larger businesses as it is a complex, lengthy and potentially expensive business. Although it gives the business the tools they need to succeed. It has flexibility in that repayment plans can be modified as the business environment changes.

Whether an individual or a business, discharge generally means that the debtor is free from debts in existence prior to filing the petition.

Finding A Good Attorney Might Require Some Research

May 11th, 2010

Trying to locate a great lawyer in your neighborhood is easier said then done. You could imagine the poor individuals that live in rural areas. This information should provide some tips on what course of action you should take first in obtaining a lawyer.

It seems like yesterday when I was trying to retain my first attorney, and I decided to utilize the reliable old “phone book”. I opened the phone book up to “counselors of law”, and found about five pages of names, corporate firms, legal and semi-legal practices and there were some paralegals listed as well. What a job this turned out to be, as I reached out to a few of the locations, and most of them wanted or better yet demanded, a significant binder.

They had to be kidding I initially thought. I mean I hadn’t even spoken with an attorney as of yet and all they wanted was my money. I thought that maybe this good old “yellow pages” strategy wasn’t as great as it was hyped up to be. I will start asking around was my next strategy, but this was also difficult.

I figured that the best course of action would be to reach out to some neighbors, and see if they knew anybody who was well versed in real estate law. I figured that I could deal with the “what’s wrong” questions, so I was blatantly open with everybody. As luck would have it, there were several neighbors who knew some good lawyers that were close to home.

This truly saved me and my family a lot of time. I didn’t have to do the horrible “cold calling”, by visiting some of these law firms. I also trusted the advice that many of these associates had given me, as they were really great neighbors and friends.

Trying to find a great lawyer in your area can be a challenge to say the least. My advice at this point is to first inquire with some friends and associates. See who they think might be a good fit for you and your needs. It’s possible they could lead you onto an attorney who will fulfill your needs for years

We also want you to keep in mind that your experience with the recommended attorney might not be the same experience the person who did the recommending had. It could vary from person to person. Just a tip to keep in mind.

Using Your Social Connections to Find a Lawyer

May 10th, 2010

In some regards, finding a lawyer has much in common with finding a number of other professionals or skilled individuals. For example, it is common for those who are looking for a new family doctor to ask friends, relatives and coworkers if they have any recommendations or advice. This, of course, makes a great deal of sense as having the opinion of someone that you trust can go a long way in making a correct decision.

In the days before email, asking people for help on any topic was a much more time consuming proposition. However, email and the Internet has changed all of that. Today, you don’t have to spend hours calling around talking to people that you haven’t spoken to in months or years. Instead a quick email can cover the same territory. Luckily, this also holds true for your friends as well. This, of course, means that your friends, coworkers and family can also quickly ask their connections for a legal referral as well.

Once you have a legal referral, for example, let’s say one of your college friends has a brother that is a lawyer; realize just how important this referral happens to be. The simple fact that this lawyer does not practice the type of law that you need help with doesn’t mean that he or she is a dead end. It is quite possible that they will be able to direct you to someone else who is more suited to your needs. This happens all the time and could prove to be very helpful to you.

It is important to realize that technology has changed how you can reach out and search for a lawyer. It has also changed the speed at which it can happen. In short, technology has made it easier for you to cover a good deal of virtual ground rather quickly. By using your own social networks and those of your friends, coworkers and relatives, you should be able to cast a rather impressive net in your search for legal representation.

You should also use your own social networks to explore what kind of help may be available to you. Reaching out to friends and acquaintances through email and instant messaging is a good way to see if someone can point you in the right direction. People enjoy being helpful, especially when there is very little time involved in the process. You might find that your second cousin that you nearly forgot all about has a friend in your area that has been practicing law for years. This kind of referral can really get the ball rolling, and you can have competent legal help in no time!
